The Supreme Court Killed AI Copyright. What Now?
I was staring at a folder of 400 concept assets generated in Midjourney v7.1 when the news broke. The Supreme Court officially passed on hearing the big AI copyright case. That was it — the final nail. If a machine spit it out, you don’t own it.
My phone immediately started blowing up with texts from panicked clients. “So anyone can just take our new mascot?” Well, Dave, they absolutely can.
We’ve been living in this weird legal gray area for a few years now, pretending the courts might eventually side with prompt engineers. But that fantasy is officially dead. The US Copyright Office has been stubbornly insisting that only human authorship gets protection, and by refusing to hear the appeal, the highest court in the country basically just shrugged and agreed. The door is closed.
The $14,000 Metadata Trap
And here is where this gets incredibly messy for those of us actually working in production. Last Tuesday, I had to scrap a $14,000 freelance contract because the client’s legal team realized the background plates I made couldn’t be trademarked. They wanted exclusive rights to the IP, and I couldn’t give it to them.
You might be thinking you can just lie about it. Just generate the image, upscale it, and claim you painted it in Clip Studio. But good luck with that.
You see, here’s the edge case nobody talks about until they get a rejection letter from the copyright office. If you use Photoshop 27.2—the big January update—and rely heavily on Generative Fill, Adobe bakes Content Credentials right into the file’s metadata. The copyright examiners are literally scanning files for c2pa.action tags now. I found this out the hard way last month. I spent three days manually overpainting a sci-fi book cover, but because I left the base AI generation layer hidden in the original PSD file I submitted for registration, the whole thing got flagged and denied.
God, that was annoying. Three days of brushwork invalidated because of a hidden layer.
The “Human Enough” Loophole
So how are we actually getting around this? The industry is quietly adopting what we call the “Ship of Theseus” workflow. You can’t copyright the raw AI output, but you can copyright your specific human modifications to it. If I generate a cyberpunk city, that’s public domain. But if I spend six hours painting a specific neon sign, adding custom characters, and completely altering the lighting setup, that specific composite becomes my IP.
The problem is the burden of proof. I now have to screen-record my entire Photoshop session just to prove to a government bureaucrat that my hand was on the stylus for a sufficient amount of time. We went from AI saving us dozens of hours to spending half that saved time doing legal compliance paperwork.
The Studio Divide
And the irony here is that the massive entertainment conglomerates don’t care about this ruling at all. Disney, Warner, and the big gaming studios have already moved on. They are training their own closed-loop models on their massive, decades-old archives of owned IP. When their internal AI generates an image of a famous mouse, they don’t need to copyright the new image. The character itself is already protected by existing trademark law.
It’s the indie creators, mid-tier ad agencies, and freelance concept artists who are taking the hit. We rely on commercial models trained on the open web, which means our outputs are legally naked.
By Q3 2027, I expect we’ll see a massive cottage industry of “IP-washing” services pop up. Agencies will charge a premium to manually trace or re-paint AI concepts just enough to pass the human authorship test, effectively laundering the open-source generation into a copyrightable asset. It’s a ridiculous workaround, but that’s where the market is heading.
Until then, I’m keeping my prompt windows open. But I’m definitely charging clients an extra 30% for the manual overpaint phase. Someone has to pay for the legal headache, and it sure isn’t going to be me.
